Terms of Service

Effective date: September 30, 2026

These Terms of Service (the "Terms") govern access to and use of the Device Nanny desktop application (the "Application") and the website located at devicenanny.com (the "Website"), each provided by Device Nanny Inc., a corporation incorporated under the laws of Ontario, Canada ("Device Nanny," "we," "us," or "our"). By creating an account, downloading the Application, or using the Website, you ("you" or the "User") agree to be bound by these Terms. If you do not agree, do not use the Application or Website.

1. Description of the service

The Application is software for the Microsoft Windows operating system that reads the list of applications installed on a mobile device connected to the User's computer and compares that list against a database of applications maintained by Device Nanny (the "Database"). The Application is a periodic inspection tool. It does not monitor devices continuously, does not operate in the background, and does not access the contents of a connected device beyond the list of installed applications.

2. Eligibility and authorized use

You must be at least 18 years of age to create an account. You represent that, with respect to any device you connect to the Application, you are the parent or legal guardian of the device's user, or otherwise have lawful authority to inspect the device. You are solely responsible for ensuring that your use of the Application complies with all applicable laws. Use of the Application to inspect a device without lawful authority is prohibited.

3. Accounts

An account is required to use the Application. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Subscription plans are licensed per household: the One Device plan permits use with one mobile device, and the All Devices plan permits use with the mobile devices of members of a single household. Accounts may not be shared with, or transferred to, persons outside the User's household.

4. Plans, fees, and payment

The free plan permits one scan. Paid plans are billed annually in Canadian dollars and are processed by Stripe, Inc. Paid plans renew automatically at the end of each annual term unless cancelled before the renewal date. Current prices are published on the pricing page. Device Nanny may change prices; any change will apply at the User's next renewal and will be communicated to the User in advance.

You may cancel a paid plan at any time from within the Application or by contacting info@devicenanny.com. Cancellation takes effect at the end of the current paid term, and access continues until that date.

5. Refunds

A User who purchases a paid plan for the first time may request a full refund within 14 days of the initial purchase by contacting info@devicenanny.com. Renewal payments are not refundable. Users who do not wish to renew must cancel before the renewal date.

6. Limitations of the service

The Database is maintained with reasonable care but is not exhaustive. New applications are released continuously, and the Database may not include every application that a User might consider a risk. A scan result that identifies no flagged applications does not constitute a representation that a device is safe, and a flagged application does not constitute a representation that the device's user has engaged in any conduct. The Application reports applications installed at the time of a scan and changes since the previous scan; an application installed and removed between two scans will not be reported.

7. Disclaimer of warranties

THE APPLICATION AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. DEVICE NANNY DOES NOT WARRANT THAT THE APPLICATION WILL BE COMPATIBLE WITH ANY PARTICULAR DEVICE, CABLE, OR VERSION OF THE WINDOWS OPERATING SYSTEM.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVICE NANNY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE APPLICATION OR WEBSITE. DEVICE NANNY'S TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY THE USER TO DEVICE NANNY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Privacy

Device Nanny's collection and use of personal information is governed by the Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual property

The Application, the Database, the Website, and all associated content, trademarks, and branding, including the Device Nanny name and mascot, are the property of Device Nanny Inc. and are protected by applicable intellectual property laws. Subject to these Terms, Device Nanny grants the User a limited, non-exclusive, non-transferable, revocable licence to use the Application for personal, non-commercial purposes. The User shall not copy, modify, distribute, sell, sublicense, reverse engineer, scrape, or otherwise extract the Database or any part of the Application.

11. Suspension and termination

The User may terminate these Terms at any time by cancelling any paid plan and uninstalling the Application. Device Nanny may suspend or terminate an account, without refund, where the User breaches these Terms or uses the Application in violation of applicable law. If Device Nanny discontinues the Application, paid subscribers will receive reasonable advance notice and a pro-rated refund of the unused portion of their current term.

12. Amendments

Device Nanny may amend these Terms from time to time. Amendments will be posted on this page with a revised effective date. Where an amendment materially affects the User's rights, account holders will be notified by email before the amendment takes effect. Continued use of the Application or Website after the effective date constitutes acceptance of the amended Terms.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties attorn to the exclusive jurisdiction of the courts of the Province of Ontario.
